Anulación de resolución y reinicio del proceso
La sentencia anula la Resolución ST-1207 de 2022 y obliga a reiniciar el trámite administrativo de certificación de consulta previa, basándose en la información proporcionada por las alcaldías de los municipios afectados. Esta medida se toma en respuesta a la omisión de este proceso en el proyecto de la segunda calzada Luruaco-Sabanalarga.

Para líderes comunitarios como Rubén Llanos, integrante del Comité No al Peaje, esta decisión representa un paso hacia la justicia. “Esta noticia nos motiva a seguir en la lucha, ya que se está haciendo justicia al evidenciar que el proyecto se aprobó de manera ilegal, sin consultar a las comunidades afectadas”, afirmó Llanos.
Plazo de notificación a las autoridades
El fallo también establece un plazo de 48 horas para que las alcaldías de Luruaco, Repelón y Sabanalarga notifiquen a la Autoridad Nacional de Consulta Previa, la Agencia Nacional de Infraestructura (ANI) y Autopistas del Caribe S.A.S. sobre la existencia de comunidades étnicas bajo su jurisdicción. Esta decisión refuerza el compromiso con los derechos de los pueblos indígenas y afrodescendientes, asegurando que sean parte del proceso de planificación y ejecución del proyecto.
