La Corte Constitucional ha tomado medidas drásticas contra el ministro de Salud y Protección Social, Guillermo Alfonso Jaramillo, tras declarar un incumplimiento generalizado en los pagos de los presupuestos máximos destinados a financiar servicios y tecnologías de salud a través de las EPS.
Incumplimientos en el pago de recursos
La Sala Especial de Seguimiento a la Sentencia T-760 de 2008 señaló que el Gobierno Nacional, liderado por Gustavo Petro, no ha cumplido con los compromisos de pago correspondientes a los presupuestos máximos de 2022. Estos recursos, valorados en 819 mil millones de pesos, fueron autorizados por el Consejo Superior de Política Fiscal (Confis) en diciembre de 2023 para ser pagados con cargo al presupuesto de 2024. Sin embargo, el Ministerio de Hacienda no ha transferido los fondos, incumpliendo así el Auto 2881 de 2023.
El alto tribunal también determinó que no se avanzó en la creación de una metodología unificada para definir y reajustar los presupuestos máximos, otra obligación establecida en el mismo auto.
Incidente de desacato contra Guillermo Jaramillo
Ante estas irregularidades, la Corte Constitucional decidió abrir un incidente de desacato contra el ministro Guillermo Alfonso Jaramillo. El proceso busca determinar su responsabilidad en el incumplimiento de las órdenes judiciales emitidas por la Corte, relacionadas con la financiación adecuada del sistema de salud.
Desfinanciación del sistema
La Corte alertó sobre una evidente desfinanciación del sistema de salud, que se refleja en retrasos y ajustes parciales a los presupuestos máximos, los cuales no cubren los gastos del segundo semestre de 2024. Según el tribunal, los recursos continúan definiéndose de forma fragmentada, para periodos cortos, y los pagos se realizan tardíamente.
“La persistencia de estas falencias pone en riesgo la sostenibilidad del sistema y vulnera el derecho fundamental a la salud de los colombianos”, afirmó la Corte en su comunicado.
Órdenes específicas al Ministerio de Salud
La Corte Constitucional ha emitido tres órdenes claras para garantizar el cumplimiento de los compromisos financieros:
- Pago de los presupuestos máximos de 2024: Los recursos correspondientes a los meses de julio, agosto, septiembre y octubre deben ser transferidos de inmediato.
- Reconocimiento de presupuestos pendientes: Los valores correspondientes a noviembre y diciembre de 2024 deben ser definidos a más tardar el 30 de enero de 2025.
- Cumplimiento de pagos en 2025: El Ministerio de Salud deberá garantizar que los pagos de los presupuestos máximos de cada mes se realicen dentro de los primeros 15 días del periodo correspondiente. Los pagos de enero y febrero de 2025 deberán efectuarse antes de que termine febrero.
Un llamado al cumplimiento
Este incidente subraya la necesidad de fortalecer la gestión y planificación financiera en el sector salud para garantizar la atención oportuna a la población. La Corte Constitucional ha reiterado que el cumplimiento de estas órdenes es crucial para salvaguardar los derechos de los ciudadanos y evitar mayores tensiones en un sistema que enfrenta serios desafíos.
